Fulton County District Attorney Fani Willis is reportedly considering using the Racketeer Influenced and Corrupt Organizations (RICO) Act to charge Trump and his associates with a variety of crimes, including conspiracy to commit election fraud, bribery, and obstruction of justice.

The RICO Act is a powerful tool that can be used to prosecute organized crime. It allows prosecutors to charge individuals with crimes even if they did not personally commit the underlying acts, as long as they were involved in a criminal enterprise.
In Trump’s case, prosecutors could argue that he was part of a criminal enterprise that was dedicated to overturning the election results in Georgia. They could point to his phone call to Georgia Secretary of State Brad Raffensperger, in which he pressured Raffensperger to “find” enough votes to change the outcome of the election.

They could also point to Trump’s attempts to pressure state officials in other swing states, as well as his fundraising efforts to support his efforts to overturn the election.
If Willis charges Trump and his associates with RICO violations, it could be a major blow to the former president. RICO convictions carry stiff penalties, including lengthy prison sentences.
It is still too early to say whether Willis will actually charge Trump with RICO violations. However, the fact that she is considering doing so is a sign that the investigation is serious and that Trump could face serious consequences.
